Terms & Conditions – My Happy Bai (Complete & Detailed – 35 Clauses)

Equal to One Month’s Salary + ₹1,250 (One-time Registration Charge)

Example: ₹50,000 + ₹1,250 = ₹51,250 (Payable before maid joining)


1. Placement Fee (Agency Charges)

The client agrees that the agency service/placement fee shall be equivalent to one full month’s salary of the selected maid/caregiver. This amount is payable in advance before the maid joins duty. The placement fee covers sourcing, matching, coordination and support services, not maid salary.

2. Non-Refundable Registration Fee

A one-time non-refundable registration charge of ₹1,250 is applicable. This fee is charged for enquiry handling, consultation, requirement understanding and profile sourcing. It is payable irrespective of whether the client finally hires or not.

3. Minimum Salary Understanding

The client clearly understands that minimum maid salary generally starts from ₹40,000 per month for 24×7 live-in candidates. Actual salary may increase depending on workload, experience, language skill, city, household size and specialised care requirements.

4. Nature of My Happy Bai Services

My Happy Bai is a placement and coordination agency only. The agency does not employ maids directly and does not act as contractor or employer. After joining, the maid becomes a direct employee of the client.

5. Employer–Employee Relationship

After placement, the legal employer of the maid is the client alone. The agency has no responsibility for salary disputes, behaviour issues, working environment, safety conditions, food arrangements or accommodation provided by client.

6. Salary Payment Responsibility

Monthly salary must always be paid directly by the client to the maid. The agency neither collects nor distributes maid salary and will not interfere in salary transactions or disputes.

7. Job Description & Clarity Before Joining

The client must clearly explain duties, working hours, type of work, children/elder care needs and off-days before maid joins duty. If job expectations keep changing repeatedly, the maid has right to resign and replacement will not be applicable.

8. Two Mandatory Paid Leaves Every Month

The maid is entitled to two paid leaves per month. If leave is not granted, the client must pay equivalent additional salary. Denial of leave will be treated as violation of policy and agency will not support disputes arising out of it.

9. Only 24×7 Live-in Candidates Provided

The agency provides only live-in, stay-in 24×7 type candidates. Clients searching for part-time, hourly, or day-shift services are requested not to proceed with enquiry.

10. No Free Trial Period

There is no trial period. Work starts from day one and charges apply from day one. Clients cannot demand “demo work”, free testing or unpaid trial days.

11. Free Replacement Policy

Within 11 months of joining, up to three replacements may be arranged if genuinely required. Replacements depend on availability and are provided for similar role and salary only.

12. When Replacement Will Not Be Provided

Replacement will not be provided if maid leaves due to:
  • verbal/physical abuse
  • over-work beyond agreed duties
  • salary not paid or delayed
  • unsafe living conditions
  • client relocation to another city
  • work totally different from what was discussed

13. No Refund Policy

Once the maid joins duty even for a single day, agency charges and registration fees are strictly non-refundable. Refund requests will not be entertained under any circumstances including dissatisfaction or voluntary termination by client.

14. Temporary Absence Policy

If maid informs leave of 1-15 days and confirms return date, the client must wait. Replacement will be provided only if she does not return beyond 15 days.

15. Background Documents

The agency shares documents as provided by candidate. Client agrees final verification, police verification, society verification and ID authentication are their own responsibility.

16. Police Verification Responsibility

Police verification must be completed by the client according to their local law or society rules. Agency is not responsible for delay/approval/rejection of police verification.

17. Theft, Loss or Damage Liability

In case of theft, jewellery loss, cash loss, fraud or property damage, the agency shall not be held responsible in any manner. Such disputes are strictly between client and maid only.

18. Behaviour and Performance Disclaimer

The agency does not guarantee honesty, behaviour, work quality, cooking taste, speed, or personal nature of maid. Human behaviour varies and agency cannot control personality traits.

19. Attendance & Continuity of Service

The agency does not guarantee duration of service by maid. If the maid resigns at her own will, the agency can only assist with replacement as per policy.

20. Advance Salary Risk

If the client pays advance salary or loan to maid, it is entirely at client’s risk. Agency will not compensate or refund if maid leaves after taking advance.

21. Health, Illness & Medical Care

If maid falls sick or requires treatment, first-aid and primary assistance are client’s responsibility. Medical expenses are to be mutually discussed between maid and client.

22. Extra Work & Additional Responsibilities

Any work not originally discussed such as additional houses, shops, offices, guests or pet care must be paid separately. Client cannot force unpaid additional work.

23. Change of Job Role

Client cannot switch job role such as from maid to nanny, or cook to elder-care without agency approval. Unauthorized change makes replacement invalid.

24. Respect & Human Treatment

The client agrees to provide safe, respectful and non-abusive environment. Any incident of violence, harassment, misbehaviour or mental torture immediately voids agency responsibility.

25. Accommodation & Food for Live-in Maids

Basic sleeping place, hygienic washroom access and food are client responsibility for live-in maids. Unhygienic or unsafe accommodation is grounds for maid resignation.

26. Travel & Joining Expenses

All travel expenses for maid to reach client’s home or return will be borne by client. Agency will not pay transportation costs.

27. Direct Hiring Restriction

Client shall not hire any candidate directly bypassing agency or after rejecting via agency. If found, full placement fee becomes immediately payable.

28. Sharing of Candidate Details

Client shall not share candidate contact or documents with third-party agencies or others for employment usage.

29. Independent Decision of Maid

The maid works purely by her own consent. Agency does not force maid to work for any specific client or under any condition.

30. Legal Disputes Between Client & Maid

Any legal matter arising between maid and client shall be handled by them directly. Agency cannot be made party in dispute, FIR or civil/criminal case.

31. Communication Disclaimer

All WhatsApp, call, SMS communication is informational. Agency is not liable for misinterpretation of verbal communication.

32. Annual Renewal

Services remain valid for 11 months from date of joining and thereafter renewal fee must be paid.

33. Force Majeure

Agency is not responsible for disruptions due to pandemic, lockdown, strikes, transport shutdown or government orders.

34. Jurisdiction

All disputes, legal notices and court matters shall fall strictly under Mumbai jurisdiction only.

35. Valid Payment Clause

All payments are valid only when made in favour of:

👉 “Jayram Mandal” Payments made to anyone else shall be treated as invalid.
